You and a parent or legal guardian should carefully read the following
legal terms of use before using the chat rooms. By using the chat
rooms or indicating your arrangement in the introductory screen, you
are agreeing to become bound by the terms of these legal terms of
use and indicating your acceptance of these legal terms of use. If
you do not agree with them, you should not use the chat rooms.
1. Chat room.
We agree to provide you access to the chat room in accordance with
these legal terms of use. Chat rooms are provided for personal use.
You must obtain access to chat rooms through your own Internet connection
account with another company. Our chat rooms are only for the use
of individuals under the age of 18.
2. Limitations of Service.
Unfortunately, computers need routine maintenance and sometimes break
down; we cannot control when subscribers access its server. As a result,
we do not guarantee that you will be able to access the chat rooms
at any particular time. Our chat rooms are provided on an "as-is,
as-available" basis. Whilst we will not intentionally inspect
the contents of your transmissions, we reserve the right to co-operate
fully with local or governmental officials in any legally authorised
investigation concerning in relation to any transmissions transmitted
via the chat rooms.
3. Your Responsibilities.
(a)
You are responsible for the use of your account by anyone using your
account. You are responsible for insuring that any user of your account
fully complies with the legal terms of use.
(b)
You are responsible for providing and maintaining all personal computer
and communications equipment and Internet access accounts necessary
to gain access to the chat rooms.
(c)You
are responsible for any communications, messages and other information
that you receive as a result of your use of the chat rooms and bear
the entire responsibility for any losses that you may experience as
a result of your use of the chat rooms.
(d)You
agree to inform us of any apparent breaches of security, such as loss,
theft, or unauthorised disclosure or use of a password or credit card.
Until we are notified, by electronic or conventional mail, or by telephone
at offices of a breach of security, you will remain liable for any
unauthorised use of your mykindaplace account.
(e)You
agree to use the chat room in a manner consistent with any and all
applicable laws and regulations.
(f)
Any action by you that, in our sole opinion, restricts or inhibits
other subscribers from using and enjoying the chat room is strictly
prohibited.
(g) We
do not want to play any part in your publishing or receiving defamatory
remarks or obscene materials, or misappropriating the property rights
of others. However, we cannot effectively monitor or edit the content
of chat transmissions. You specifically agree not to submit, publish,
or display on or through the chat rooms any defamatory, inaccurate,
abusive, obscene, profane, sexually orientated, threatening, racially
offensive, or illegal material; nor shall you encourage the use of
controlled substances.
YOU SPECIFICALLY AGREE THAT WE WILL NOT BE RESPONSIBLE FOR ANY SUCH
MATERIAL PUBLISHED BY YOU OR RECEIVED BY YOU AND YOU FULLY RELEASE
AND INDEMNIFY US FROM ALL LIABILITY AND RESPONSIBILITY FOR ANY SUCH
TRANSMISSIONS, PUBLICATIONS OR RECEIPT.
Transmission of material, information or software in violation of
law or regulation is prohibited. You specifically agree not to upload,
post or reproduce in any way any materials protected by copyright
without the permission of the copyright owner.
(h)
If you violate the restrictions in these legal terms of use, you agree
to indemnify us for any losses, costs or damages, including reasonable
legal fees incurred by us and relating to, or arising out of such
a breach. You, not us, are responsible for your behaviour.
4. Software.
You are responsible for obtaining your own software to use the chat
rooms.
5. Limitations of Liability
ALL THE CHAT ROOMS ARE PROVIDED TO YOU "AS IS" WITHOUT WARRANTY
OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED
TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, OR INFRINGEMENT. THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE,
AND USE OF THE SERVICES IS WITH YOU.
6. Term and Termination.
Your access to and use of the chat rooms may be terminated at any
time, for any reason or for no reason by us.
7. Entire Agreement.
These legal terms of use contain the entire understanding between
us with respect to use of the chat rooms and no representations, statements
or inducements, oral or written, not contained herein shall bind either
of us.
Miscellaneous.
Should any part of these legal terms of use, for any reason, be declared
invalid by a court of competent jurisdiction, such determination shall
not affect the validity of any remaining portion, and such remaining
portion shall remain in force and effect, as if these legal terms
of use had been had the invalid portion eliminated. These legal terms
of use are governed by and construed in accordance with the laws of
England and Wales. These legal terms of use shall be binding upon
and inure to the benefit of each of us and our respective heirs, successors
and assigns.
